Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Mantle mobile application (the "App") or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 18 years old and a resident of the United States to use the Service. By using Mantle, you represent and warrant that you meet these eligibility requirements.

3. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. You may not:

Copy, modify, or distribute the App or any part of it.
Reverse engineer, decompile, or disassemble the App.
Rent, lease, lend, sell, or sublicense the App.
Use the App for any commercial purpose without our written consent.
Remove or alter any proprietary notices or labels on the App.

4. Your Content

You retain ownership of any data, text, photos, or other content you submit to the Service ("Your Content"). By using the Service, you grant us a limited, worldwide, non-exclusive license to use, store, and process Your Content solely to provide and improve the Service.

You are responsible for Your Content and represent that you have the right to submit it. We do not claim ownership of Your Content and will not use it for purposes unrelated to the Service.

5. AI-Powered Features

Mantle uses artificial intelligence to generate personalized home maintenance tasks and recommendations. You acknowledge and agree that:

AI-generated tasks and recommendations may not be accurate, complete, or appropriate for your specific situation.
AI-generated content is for informational purposes only and does not constitute professional advice (including but not limited to home inspection, engineering, plumbing, electrical, or HVAC advice).
You are solely responsible for evaluating and acting on any tasks or recommendations provided by the Service.
You should consult qualified professionals for any maintenance work that requires specialized knowledge or licensing.

6. Household Sharing

The Service allows home owners to invite other users to join their household. By using household sharing features, you acknowledge that:

The home owner controls household membership and may add or remove members at any time.
Data associated with a home (including tasks, schedules, and professional contacts) is shared with all household members.
Actions taken by household members (such as completing or rescheduling tasks) are visible to all other members.
If you are removed from a household, you will lose access to that home's data.

7. Prohibited Uses

You agree not to use the Service to:

Violate any applicable law, regulation, or third-party rights.
Upload or transmit viruses, malware, or other harmful code.
Attempt to gain unauthorized access to the Service or its related systems.
Interfere with or disrupt the Service or servers connected to it.
Scrape, harvest, or collect data from the Service by automated means.
Impersonate any person or entity or misrepresent your affiliation.
Use the Service to send spam or unsolicited communications.
Use the Service in any manner that could damage, disable, or impair it.

8. Intellectual Property

The Service, including its design, code, features, content, trademarks, and logos, is owned by Mantle and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use the Mantle name, logo, or trademarks without our prior written consent.

9. Third-Party Services

The Service integrates with third-party services including Supabase, Anthropic, Google Places, Mixpanel, Expo, and Resend. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF AI-GENERATED CONTENT, MAINTENANCE RECOMMENDATIONS, OR ANY INFORMATION PROVIDED THROUGH THE SERVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MANTLE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold harmless Mantle and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit to the Service.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your license to use the Service will immediately end. Provisions of these Terms that by their nature should survive termination (including Sections 8, 10, 11, and 12) will survive.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York.
